Since the LSRP program began in New Jersey over 500 LSRPs obtained temporary status. In 2012, the exam to achieve permanent LSRP status was finalized and has since been offered four times. Many temporary LSRPs and candidates new to the program have taken the exam and there are now approximately 500 permanent LSRPs licensed in New Jersey. There are, however, many temporary LSRPs that have not obtained the permanent status. In some cases this is because the temporary LSRP chose not to pursue the permanent status, and in some cases it is because the temporary LSRP failed to pass one of the four offered exams. It has also been determined that these temporary LSRPs that lost their status must wait at least one year from the date of their termination before they are eligible to take the examination....more

In the pre-LSRP world, property owners (i.e., Responsible Parties) and consultants worked at varied paces. Many remediation projects were conducted under the voluntary cleanup program and even in cases where the cleanup was required, the NJDEP rarely used enforcement measures to force responsible parties and property owners to move expeditiously on low risk sites. Projects would often stagnate because the necessary resources were not available or while waiting for NJDEP to respond on submissions. ...more

In July 2012 NJDEP issued letters to owners and operators of underground storage tank (UST) systems titled “Compliance Assistance Alert – Underground Storage Tank Registration Certificates.” The letters cite the State’s Site Remediation Reform Act (SRRA), which stipulates that remediation of past and future discharges is the responsibility of UST owners and operators, and that a Licensed Site Remediation Professional (LSRP) must be hired to oversee remediation at all regulated UST sites (including those for which tank closure reports are outstanding). ...more

JM Sorge, Inc. (JMS) was retained by a property owner in Union County, New Jersey to complete the clearance of their property under the New Jersey Industrial Site Recovery Act (ISRA). An earlier investigation conducted by others identified polychlorinated biphenyls (PCB) contamination in the onsite soil at concentrations above 50 ppm. Due to the high concentrations of PCBs, the United States Environmental Protection Agency (EPA) requires that a Self-Implementing Cleanup and Disposal Plan (SIP) be submitted and approved before remediation of the PCB waste can commence....more

The NJ Department of Environmental Protection (NJDEP) has begun sending letters to Responsible Parties and site owners regarding site specific information that will be used to ultimately calculate a Remedial Priority Score (RPS) for a site. The New Jersey Site Remediation Professional Licensing Board and the Licensed Site Remediation Professional Association (LSRPA) offered the first New Jersey LSRP exam on Monday May 14, 2012. The first exam was offered in two locations and was only open to candidates that currently hold a temporary license. The candidates were given three and one half hours to answer 165 multiple choice questions. Examinees were sworn to secrecy with regard to revealing the contents of the exam so no specifics are offered here, but suffice to say the exam ran the gamut of the regulatory requirements for site remediation in New Jersey and also covered some project management and practical financial and administrative issues. ...more

The NJDEP plans to rank all contaminated sites in New Jersey. The sites will be ranked based on the Remedial Priority Scoring (RPS) System which is a modeling system designed by the NJDEP. On March 9, 2012, New Jersey Future held their 7th annual Redevelopment Forum. JMS was proud to be a sponsoring colleague of the event, and Tom Burke and Pete Sorge of JMS were in attendance. The forum was centered around several key speakers, with morning and afternoon breakout sessions into smaller discussion groups. Issues discussed covered a variety of emerging redevelopment issues, including smart growth, urban planning, green energies, foreclosures, flooding, and funding sources. The Senate and General Assembly voted to concur with the recommendations made by Governor Christie earlier in the day in his Conditional Veto of Assembly Bill No. 2464, which requires all state agency rules to be published in the NJ Register, and prohibits the use of regulatory guidance documents except under certain circumstances. In December 2011, the New Jersey Department of Environmental Protection (NJDEP) distributed a Job Task Analysis Survey to each of the temporary Licensed Site Remediation Professionals (LSRP) currently practicing in the state of New Jersey. The goal of the Job Task Analysis was to solicit the opinions of each LSRP regarding what tasks form the basis for an LSRP to effectively do their jobs. The survey was only completed by current New Jersey LSRPs to ensure that the content of the licensing examination is directly related to the core tasks that are regularly required for an LSRP to evaluate and, if necessary, remediate a site in the most efficient manner while protecting human health and the environment. The Job Task Analysis included a wide variety of questions on subjects such as technical expertise, regulatory criteria, regulatory knowledge, professional ethics, and the role of the LSRP as a “regulator”. ...more

Over the past few years at the NJDEP, there have been a lot of changes; new regulations, new guidance, etc., and let’s not forget the NJDEP’s move to bring all NJ Site Remediation cases into LSRP program by May 2012. While this change will likely increase the rate at which cases are processed and closed and possibly stimulate the economy by freeing up development and real estate transactions, it may also raise concerns for property owners. In the past, the NJDEP has had a presence on every environmental case to ensure protection of human health and the environment, and to ensure compliance with regulations. In this new world, that role has changed, and now that role is played by the consultant, or LSRP. With this arrangement, it is more important than ever for clients to trust that their consultants are competent and will “do the right thing.”...more

As with every profession, the environmental world is changing in response to advances in technology. Environmental consultants & scientists in the field can now use their smart phones to take pictures of sample locations, use the GPS locater (in a pinch), email their supervisor pictures of site conditions, log soil conditions in a mobile soil boring program, and the list goes on and on. Besides the basic functions of a smart phone, there are numerous applications, or apps, that are starting to appear on the market. Some of the current environmental focused apps will give you access to USDA soil survey data, and there are even laboratory apps for sample processing....more

When the Site Remediation Reform Act (SRRA) was enacted in 2009 It provided for the establishment of a Site Remediation Program Licensing Board (SRPLB) to oversee the Licensed Site Remediation Professionals (LSRPs) who would implement the Act. The Act further specified that the SRPLB would be comprised of a diverse group of individuals representing industry, state regulators, academia, the environmental community, and LSRPs themselves. The NJDEP posted proposed rules to complete the phase-in of the Site Remediation Reform Act (SRRA) The SRRA is the law that changes the way contaminated sites are investigated and remediated and it also established the Licensed Site Remediation Professional (LSRP) program. It has been over a week since Hurricane Irene had barreled through the region; however, the effects of the storm persist.
