Newark, New Jersey
JMS was retained by a community based non-profit organization that is dedicated to the redevelopment of a 57-lot section of Newark, New Jersey. To help reach that goal, JMS has guided our client through the financial, technical and regulatory challenges that environmental issues pose at this brownfields redevelopment site.
The project is complicated by several environmental issues including leaking underground storage tanks and historic fill tainted by metals and poly-aromatic hydrocarbons (PAHs).
JMS worked with the non-profit organization to develop and implement a strategy to attain public funding for the project. So far the following tasks have been accomplished:
- Applying for Brownfields Development Area (BDA) status;
- Participating in an NJDEP Brownfields Interagency Team (BRIT) meeting;
- Applying for Hazardous Discharge Site Remediation Funds (HDSRF); and
- Applying for an Underground Storage Tank (UST) fund grant
The project has currently been awarded HDSRF funds for the Preliminary Assessment and Site Investigation work that is required at the site.
JMS has coordinated collaboration and cooperative work between our client and the NJDEP. In the initial phase of the project, JMS removed an underground storage tank and attained a No Further Action (NFA) letter from the NJDEP within a compressed timeframe using the Cleanup Star program. In addition, JMS has proposed capping the remaining low level soil contamination that resulted from the historic fill. The cap will consist of the building’s concrete slab, other impervious surfaces and clean fill in the landscaped areas, all of which will ensure that future residents do not come into contact with the contaminated soil.
The first phase of the project is currently under construction.
