A JMS client operates as a land developer. An out of service 2,000 gallon residential No. 2 heating oil underground storage tank (UST) was identified in a vacant lot. JMS was retained to remove the UST. In March 2006, the UST was removed and no corrosion holes were identified in the tank shell or piping, therefore, no soil was removed from the site. Post excavation soil samples were collected to evaluate the soil beneath the former UST location. Soil sampling results revealed one sample which required additional laboratory analysis. In order to obtain a No Further Action (NFA) letter from the New Jersey Department of Environmental Protection (NJDEP) on the UST removal, a notification was made to the NJDEP hotline and a case number was assigned. Rather than use the regular Memorandum of Agreement (MOA) voluntary cleanup approach, JMS elected to utilize the recently implemented NJDEP Cleanup Star Program. The additional analysis revealed that no contaminants were detected in excess of the strictest NJDEP soil cleanup criteria
JMS managed the project and certified the results to NJDEP under the program. NJDEP issued an NFA and CNS on May 16, 2006 and the case was closed.
A JMS client operates a construction rental equipment operation. A hydraulic line on an excavator in use on an industrial site undergoing remediation ruptured resulting in a discharge of hydraulic oil on the site. The spill was reported to the NJDEP hotline in July 2004. JMS was retained to remediate the spill and close the case. Rather than use the regular Memorandum of Agreement (MOA) voluntary cleanup approach, JMS elected to utilize the recently implemented NJDEP Cleanup Star Program.
JMS managed the cleanup project and certified the results to NJDEP under the program. The project involved the excavation and recycling of the affected soil at a facility licensed by NJDEP. The process was complicated by other cleanup operations being conducted on the site under other NJDEP oversight programs. Post excavation samples were collected and submitted to the NJDEP in the final report. NJDEP issued an NFA and CNS on November 19, 2004 and the case was closed.
