Throughout the United States, freshwater wetlands are a protected resource on both public and private property. In New Jersey, the NJDEP Land Use Regulation Program is responsible for administering the Wetlands Protection Act, thereby regulating virtually all activities proposed in a wetland or wetland buffer area. Determining whether wetlands exist on a property, and working through the numerous permitting requirements, can be a complex and time consuming process.
The experienced staff at JMS can determine the presence of wetlands on a property, as well as offer guidance as to limitations on property usage if wetlands are indeed present. Utilizing information obtained from NJDEP databases and mapping programs and supplemented by on-site field experience, JMS delineates the extent of wetlands present on a site. Once the extent of any wetlands is determined, JMS provides assistance with obtaining a Letter of Interpretation (LOI) from the NJDEP. An LOI is the official determination of the presence, absence, and boundaries of freshwater wetlands and transition areas on a site. Once wetland boundaries are established, JMS works closely with clients to determine the end use alternatives available for a site.
